General Terms and Conditions of Sale – effective from 16 October 2026

Article 1 – Introductory provisions

1.1. These General Terms and Conditions (the "Terms") govern the rights and obligations between ACTION YACHTS d.o.o. (the "Seller") and natural or legal persons (the "Customer") in the sale of goods through the Seller's online store at actionyachts.eu, at its business premises, or under individually concluded purchase contracts.

1.2. Seller details:

  • Company: ACTION YACHTS d.o.o.
  • Registered office: Savska cesta 32, 10000 Zagreb, Croatia
  • Registered with the Commercial Court in Zagreb
  • OIB: 16033688533
  • VAT ID: HR16033688533
  • E-mail: info@actionyachts.eu
  • Phone: +385 99 6469 107
  • Website: https://actionyachts.eu
  • Showroom and eFoil Center: D-Marin Dalmacija, Dr. Franje Tuđmana 24, 23206 Sukošan, Croatia

1.3. The Seller is mainly engaged in the sale, distribution, rental and servicing of electric water-sports equipment, in particular eFoils, electric surfboards, underwater scooters, batteries, chargers, spare parts and accessories, and in the sale and charter of boats.

1.4. The range includes in particular products of the brands LIFT, HOBBYWING, JETBLADE, LIND and other manufacturers represented by the Seller.

1.5. These Terms primarily govern the sale of goods. Equipment rental, boat charter and sports services are governed by separate terms (in particular the Rental Terms & Conditions at /pages/rental-terms and the charter terms stated on the respective booking page), which form part of the specific booking.

1.6. Legal relations between the Seller and the Customer are governed by the laws of the Republic of Croatia, in particular the Civil Obligations Act (Zakon o obveznim odnosima), the Consumer Protection Act (Zakon o zaštiti potrošača) and directly applicable European Union law.

1.7. Where the Customer is a consumer, these Terms do not affect the consumer's rights under mandatory provisions of law.

Article 2 – Customers and business relations

2.1. A consumer is a natural person who concludes a contract for purposes outside their trade, business, craft or profession.

2.2. A business customer is a natural or legal person who concludes a contract within their business or professional activity.

2.3. The Seller sells to end customers (B2C) as well as to businesses, distributors, partners and water-sports operators (B2B).

2.4. Individually agreed prices, payment terms, delivery times and other arrangements may apply to B2B relations.

2.5. In the event of a conflict between these Terms and an individually concluded contract, the individual contract prevails, provided it does not contravene mandatory law.

Article 3 – Product offer and information

3.1. The Seller publishes in its online store information on the products offered, their main technical characteristics, configurations, availability and prices.

3.2. Technical specifications are stated according to the manufacturers' information, technical documentation and available certifications.

3.3. Figures for maximum speed, range, battery life, load capacity and other performance characteristics are values achievable under the conditions stated by the manufacturer, unless expressly stated otherwise. Actual results depend on rider weight, water and weather conditions, temperature, configuration and style of use.

3.4. Photographs and visualisations are for illustration. The technical specification of the ordered configuration is decisive. This does not affect the Seller's liability for conformity of the goods with the description, sample or other binding information provided to the Customer.

3.5. Certain products may be sold to order or in a specific configuration chosen by the Customer.

3.6. Where a product requires special conditions of use, safety equipment, a licence or compliance with local regulations, the Seller informs the Customer of this in the product information or documentation.

Article 4 – Order and conclusion of the purchase contract

4.1. The Customer may order goods through the online store, by e-mail, at the Seller's premises or in another way agreed with the Seller.

4.2. Before completing an order, the Customer can check and correct the ordered goods, configuration, quantity, price, delivery method, payment terms and contact details.

4.3. An order placed through the online store is a binding offer by the Customer to conclude a purchase contract.

4.4. The contract is concluded when the Seller confirms acceptance of the order by e-mail. An automatic confirmation that the order has been received does not in itself constitute acceptance where this is clearly stated to the Customer.

4.5. If the Seller cannot fulfil an order, for example because a product is unavailable or has been discontinued, it informs the Customer without undue delay, offers an available solution and refunds any payment already made in full.

4.6. Changes to the configuration, delivery time or price after conclusion of the contract require the consent of both parties.

4.7. The contract confirmation and these Terms are provided to the Customer on a durable medium, in particular by e-mail.

4.8. The button completing an order that involves an obligation to pay is clearly labelled so that the Customer recognises the obligation to pay.

4.9. The contract may be concluded in Croatian or English. Consumers in Croatia are entitled to receive the contract and pre-contractual information in Croatian.

Article 5 – Prices and payment

5.1. Prices are stated in euros (EUR).

5.2. Prices for consumers include Croatian value added tax (25 %).

5.3. Costs of delivery, installation, additional accessories or other optional services are shown to the Customer before the order is completed.

5.4. The Seller may offer the following payment methods: payment card via a secure payment gateway; bank transfer; other electronic payment methods supported by the online store; individually agreed payment for B2B sales.

5.5. For equipment ordered individually, the Seller may request an advance payment. Its amount, due date and how it is credited against the purchase price are communicated to the Customer before the contract is concluded.

5.6. An advance payment is not automatically non-refundable. Settlement of an advance payment on cancellation of an order is governed by law and the specific contract.

5.7. Different payment terms or trade credit may be agreed with B2B partners.

5.8. The Seller issues an invoice in accordance with Croatian law (including fiscalisation where required).

Article 6 – Delivery

6.1. The Seller delivers in Croatia and, where possible, to other EU countries or other states, subject to available transport options and applicable legal restrictions. Details are set out in the Shipping Policy.

6.2. The delivery time is stated in the order or its confirmation. If no time is agreed, the Seller delivers without undue delay and no later than 30 days after conclusion of the contract.

6.3. For products that are not in stock and are ordered from the manufacturer, an individual delivery time may be agreed.

6.4. The Customer will be informed of any significant delay. The Customer's rights in the event of the Seller's delay are governed by law.

6.5. Delivery may take place to the Customer's address, by a contracted carrier, by personal collection at the eFoil Center in Sukošan or in another individually agreed way.

6.6. For consumer contracts, the risk of loss of or damage to the goods passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods.

6.7. For B2B customers, the passing of risk may be agreed individually.

6.8. Equipment containing lithium-ion batteries is subject to dangerous-goods transport rules. Certain delivery methods may therefore be unavailable.

Article 7 – Consumer right of withdrawal

7.1. A consumer who has concluded a distance contract may withdraw from it within 14 days without giving any reason.

7.2. The withdrawal period ends 14 days after the day on which the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods; for goods delivered in several lots, 14 days after the last lot.

7.3. The consumer exercises the right by an unambiguous statement sent by post or e-mail (info@actionyachts.eu). The consumer may use the model withdrawal form in the Refund Policy, but it is not obligatory.

7.4. The Seller refunds all payments received, including the cost of the cheapest standard delivery offered, without undue delay and no later than 14 days after receiving the notice of withdrawal, using the same means of payment, unless agreed otherwise and at no cost to the consumer.

7.5. The Seller may withhold the refund until it has received the goods back or the consumer has supplied evidence of having sent them back, whichever is earlier, unless the Seller has offered to collect the goods itself.

7.6. The consumer must send back or hand over the goods without undue delay and no later than 14 days after notifying the withdrawal.

7.7. The consumer bears the direct cost of returning the goods. Because eFoils, electric surfboards and their batteries cannot normally be returned by post and must be transported as dangerous goods, the Seller states the estimated return cost on request before the purchase and helps arrange a safe return; the goods may also be handed over free of charge at the eFoil Center in Sukošan.

7.8. The consumer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning (for example use on the water).

7.9. Merely opening the original packaging of an eFoil, surfboard or other product does not in itself cause loss of the right of withdrawal.

7.10. Exceptions to the right of withdrawal apply only in the cases provided by law, in particular goods genuinely made to the consumer's specifications or clearly personalised – not automatically every product assembled from standard options.

7.11. Instructions and the model withdrawal form in accordance with the Croatian ordinance on the content and form of information on the right of withdrawal (NN 117/2022) are set out in the Refund Policy.

Article 8 – Liability for defects (legal guarantee)

8.1. The Seller is liable to the consumer for the conformity of the goods with the contract and for defects to the extent provided by Croatian law.

8.2. For consumer sales, the Seller is liable for lack of conformity that becomes apparent within two years of delivery of the goods, under the conditions laid down by law.

8.3. If the goods are defective, the Customer may exercise the statutory rights, in particular to have the goods repaired or replaced or, where the legal conditions are met, to a proportionate price reduction or termination of the contract with a refund.

8.4. The Seller remedies justified claims of consumers free of charge and within a reasonable time.

8.5. Consumer rights cannot be excluded or limited by any provision of these Terms contrary to mandatory law.

8.6. The statutory liability for defects is independent of any commercial guarantee of the manufacturer or the Seller.

8.7. In B2B relations, certain aspects of liability for defects may be governed by a separate contract within the limits of the law.

Article 9 – Manufacturer's commercial guarantee

9.1. Selected products may be covered by a manufacturer's commercial guarantee in addition to the Customer's statutory rights.

9.2. The scope, duration and conditions of a commercial guarantee are governed by the guarantee statement of the guarantor and the information provided to the Customer before purchase.

9.3. A commercial guarantee may include repair, replacement of defective parts or other remedies stated in the guarantee statement.

9.4. If the manufacturer requires product registration for the guarantee, the Customer will be informed of this.

9.5. The Customer must use the product in accordance with the manufacturer's manual, technical requirements and safety instructions.

9.6. A commercial guarantee may contain lawful limitations, for example for wear and tear, improper handling, unauthorised interventions or mechanical damage.

9.7. No limitation of a commercial guarantee limits the consumer's statutory rights against the Seller.

Article 10 – Extended warranty and paid service programmes

10.1. The Seller may offer voluntary paid programmes of extended service cover or extended commercial guarantee (see /pages/extended-warranty).

10.2. Such programmes may include, for example, extended cover of selected components, repairs on preferential terms, technical inspections and other services expressly stated in the programme.

10.3. The price, duration, scope of cover, exclusions and claims procedure are set out in the separate terms of the respective programme.

10.4. An extended guarantee or paid service programme does not replace the Seller's statutory liability for defects.

Article 11 – Service, repairs and spare parts

11.1. ACTION YACHTS provides or arranges service for products in its range within the scope of its technical and contractual authorisations.

11.2. Service may include diagnostics, maintenance, replacement of components, repairs and other technical work.

11.3. Before carrying out a paid repair, the Customer is informed of its expected scope and price or of how the price will be determined.

11.4. If diagnostics show that the defect falls under the Seller's statutory liability, the Customer's statutory rights are handled free of charge.

11.5. Parts used meet the technical and safety requirements of the product. Original manufacturer parts are used where agreed or required by the applicable service standard.

11.6. Repairs of safety-relevant components, in particular high-voltage batteries, control units and drive systems, are carried out only by qualified persons.

11.7. Unqualified interventions by the Customer may affect product safety and may be relevant when assessing the cause of a defect; they do not in themselves remove all statutory rights.

Article 12 – Safe use of products

12.1. Electric water-sports equipment can cause injury, damage to property or other dangerous situations if used improperly.

12.2. Before first use, the Customer must read the user manual, safety instructions and any limitations of the specific product.

12.3. The product may be used only in the manner and under the conditions stated by the manufacturer and in accordance with the regulations applicable at the place of use, including maritime rules and any licensing requirements.

12.4. The user must wear appropriate personal protective and safety equipment in accordance with the manufacturer's instructions.

12.5. The product must not be used in the event of a technical fault, in dangerous weather or in other circumstances in which its operation could endanger safety.

12.6. Minimum age, weight limits, licences and other restrictions are set for each product and by applicable law; information valid for one product does not automatically apply to others.

12.7. The Seller is not liable for damage caused solely by the Customer's improper use of the product, unless liable under applicable law.

12.8. These provisions do not exclude or limit statutory liability for defective or dangerous products.

Article 13 – Batteries and chargers

13.1. Products with lithium-ion batteries must be used, stored, transported and charged in accordance with the manufacturer's instructions and safety regulations.

13.2. The Customer must use compatible chargers and respect the operating limits set by the manufacturer.

13.3. Damaged batteries and batteries showing overheating, deformation, electrolyte leakage or other signs of a fault must not be used.

13.4. Normal wear and gradual loss of battery capacity are assessed according to the product's characteristics, the manufacturer's statements, agreed parameters and the law.

13.5. Claims and transport of a defective battery must comply with the safety rules for handling dangerous goods; please contact the Seller before sending a battery.

13.6. Waste batteries must not be disposed of with household waste. The Seller takes back waste batteries of the types it sells free of charge at the eFoil Center in Sukošan.

Article 14 – Complaints

14.1. The Customer may make a claim or submit a written complaint by e-mail to info@actionyachts.eu, by post to the registered office, in person at the eFoil Center in Sukošan during opening hours, or by any other electronic means expressly offered by the Seller.

14.2. The Seller confirms receipt of a written complaint from a consumer without delay.

14.3. The Seller replies to a consumer's written complaint no later than 15 days after receiving it.

14.4. To speed up handling, the Customer is advised to state the order number, product, a description of the defect and suitable photographs. The absence of optional information does not in itself exclude the consumer's statutory rights.

14.5. Where necessary to assess a defect, the Seller may ask the Customer to make the product available or hand it over, in a way that respects the free-of-charge handling of justified consumer claims.

14.6. The Seller keeps records of written consumer complaints for the period required by law.

14.7. Making a claim against the Seller does not prevent the Customer from exercising rights against other liable persons under the law or a commercial guarantee.

Article 15 – Liability for damage

15.1. Liability of the parties for damage is governed by the laws of the Republic of Croatia.

15.2. The Seller is not liable for damage for which it is not liable under applicable law.

15.3. Nothing in these Terms excludes or limits liability for damage caused intentionally or by gross negligence, liability for death or personal injury, liability for defective products, or any other liability that cannot be limited by law.

15.4. The Customer is liable for damage caused by unlawful or contractually impermissible conduct to the extent provided by law.

Article 16 – Personal data and AI assistant

16.1. The Seller processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Croatian law. Details are set out in the Privacy Policy.

16.2. The website offers an online assistant based on artificial intelligence. It is clearly marked as an AI system in accordance with Regulation (EU) 2024/1689 (AI Act); it provides general information only and does not conclude contracts. Binding information is that stated in the order process, the order confirmation and these Terms. A member of the team can take over at any time via info@actionyachts.eu or +385 99 6469 107.

Article 17 – Intellectual property and trademarks

17.1. Trade names, logos, photographs, technical documentation and other materials on the website may be protected by intellectual property rights of the Seller, manufacturers or third parties. LIFT, LIFT5 and LIFTX are trademarks of Lift Foils; other brands belong to their respective owners.

17.2. The Customer may not use, reproduce or distribute these materials commercially without authorisation, unless permitted by law.

17.3. Purchasing a product does not grant any right to use the trademark of the manufacturer or the Seller beyond what the law permits.

17.4. Separate terms for the use of brands and marketing materials may be agreed with authorised partners.

Article 18 – Out-of-court dispute resolution

18.1. The Seller prefers amicable settlement of disputes with customers. A consumer may first submit a written complaint to the Seller (Article 14).

18.2. If the dispute is not resolved, the consumer may propose resolution before a body for alternative resolution of consumer disputes, in particular: Centar za mirenje Hrvatske obrtničke komore (Mediation Centre of the Croatian Chamber of Trades and Crafts), Ilica 49/II, 10000 Zagreb, tel. +385 1 4806 666, e-mail mirenje@hok.hr, www.hok.hr. Participation in alternative dispute resolution is voluntary for the Seller; the Seller will state its position in the reply to the complaint.

18.3. Consumers resident in another EU Member State may also contact the European Consumer Centre in their country.

18.4. This does not affect the Customer's right to bring proceedings before the competent court or other public authority.

Article 19 – Governing law and jurisdiction

19.1. Contracts between the Seller and the Customer are governed by the law of the Republic of Croatia, excluding the UN Convention on Contracts for the International Sale of Goods.

19.2. For consumers habitually resident in another EU Member State, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law of their country of residence.

19.3. Jurisdiction is determined by Croatian law and applicable EU law. Consumers may in any case sue and be sued in the courts of their place of residence as provided by Regulation (EU) No 1215/2012.

19.4. In B2B relations, the courts in Zagreb have jurisdiction, where permitted by law.

Article 20 – Final provisions

20.1. These Terms are published in the online store, and the Customer can read, save and print them before concluding the contract.

20.2. The Seller may amend these Terms. The version in force at the time the order was placed applies to each contract.

20.3. If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is not affected.

20.4. Annexes and special terms expressly referred to in the order and made available to the Customer form part of the contract.

20.5. These Terms are issued in Croatian and English. In the event of discrepancies, the Croatian version prevails, without prejudice to the rights of consumers.

20.6. These Terms take effect on 16 October 2026.
