1. Revision date

1.1 This warranty policy is valid from 5 March 2025 and replaces all previous versions.

2. Scope of the warranty

2.1 This warranty applies to all products sold by ACTION YACHTS d.o.o. or by an authorised dealer, distributor or business partner confirmed in writing by ACTION YACHTS d.o.o. ("ACTION YACHTS").

2.2 ACTION YACHTS warrants that the products will be free from defects caused by faulty materials or workmanship during the period stated in this document, under normal and intended use.

2.3 This warranty covers only defects that existed at the moment the risk passed to the buyer, within the meaning of the applicable provisions of Croatian law.

3. Warranty period

3.1 The warranty is valid for 24 months from the date of purchase stated on the invoice.

3.2 Batteries are covered by a warranty of 24 months or a maximum of 300 full charge cycles, whichever occurs first. The warranty does not cover damage caused by improper use, overcharging, deep discharge, incorrect storage or exposure to extreme conditions.

3.3 If a part is replaced under an approved warranty claim:

  • if 6 months or more remain on the original product's warranty, the replaced part takes over the remaining original warranty period;
  • if less than 6 months remain, the replaced part is covered by a minimum warranty of 6 months from the date of replacement.

3.4 If a product is repaired:

  • the warranty period is neither extended nor restarted;
  • the repaired components are covered by a 6-month warranty from the date of repair;
  • the extended cover applies only to the repaired parts, not to the whole product.

3.5 This warranty is in addition to the consumer's statutory rights under the laws of the Republic of Croatia and does not exclude any rights that cannot be limited by law.

4. Who is entitled

4.1 The warranty applies to the original buyer.

4.2 Proof of purchase is required to make a warranty claim.

4.3 The warranty may be transferred to a new owner only with the prior written consent of ACTION YACHTS d.o.o. and on presentation of valid proof of the transfer of ownership. ACTION YACHTS d.o.o. reserves the right to refuse the transfer if these conditions are not met. A transfer of ownership does not extend or restart the warranty period; it is always calculated from the original date of purchase.

5. How to make a claim

5.1 A defect must be reported without undue delay after it is discovered.

5.2 ACTION YACHTS is entitled to assess the validity of the claim on the basis of the documentation provided.

5.3 If the claim is accepted, ACTION YACHTS will, at its discretion:

  • repair the product,
  • arrange a repair by an authorised service centre, or
  • replace the product or the relevant part.

5.4 ACTION YACHTS reserves the right to charge reasonable costs for shipping a replacement product, unless this conflicts with mandatory provisions of law.

5.5 The cost of sending the product to the service centre is borne by the customer, unless the law provides otherwise.

5.6 Product registration is not a condition of the warranty.

5.7 If the claim is not accepted as justified, the customer must pay all transport and diagnostic costs.

5.8 ACTION YACHTS is not responsible for the loss of data, accessories or other items left in the product.

6. Exclusions

6.1 The warranty does not cover:

  • damage caused by misuse, vandalism, third-party intervention or neglect;
  • damage caused by failure to follow the maintenance procedures in the user manual;
  • damage resulting from failure to follow the assembly procedures or from using tools other than those specified in the user manual;
  • the use of non-approved parts or accessories;
  • products with a broken seal or showing signs of tampering;
  • damage to the carbon-fibre hull caused by impact, mechanical stress or improper use;
  • use of the product for purposes other than those intended;
  • unauthorised repairs or modifications;
  • personal injury, death, damage to property or financial loss, unless caused by intent or gross negligence of ACTION YACHTS;
  • claims made more than two months after the defect was discovered;
  • normal wear and tear;
  • damage caused by extreme weather or hazardous environments.

6.2 ACTION YACHTS reserves the right to update product specifications, manuals and instructions without prior notice.

7. Limitation of liability

7.1 To the maximum extent permitted by the laws of the Republic of Croatia, the liability of ACTION YACHTS is limited to the repair or replacement of the product or a refund of the purchase price.

7.2 ACTION YACHTS is not liable for indirect, consequential or lost damages, including loss of profit, unless such liability arises from mandatory provisions of law.
