Shipping policy

1. Overview

This shipping policy sets out the terms for the delivery of goods sold by ACTION YACHTS d.o.o. (the "Seller") to its customers (the "Buyer"). By placing an order, the Buyer confirms that they have read and agree to this policy.

2. Delivery terms (Incoterms® 2020)

Unless expressly agreed otherwise, deliveries are governed by Incoterms® 2020:

  • DAP (Delivered At Place) – standard
  • DPU (Delivered at Place Unloaded) – on request
  • DDP (Delivered Duty Paid) – only by individual agreement
  • EXW (Ex Works) – personal pickup

The applicable delivery term is always stated in the contract, order confirmation or invoice.

3. Order processing

  • An order becomes binding once it has been confirmed by the Seller.
  • Product availability is checked individually.
  • The Buyer receives an order confirmation with the expected dispatch date.

Products in stock are usually dispatched within 1–3 working days.

4. Delivery times

Delivery times are indicative:

  • Croatia: 2–5 working days
  • EU: 3–10 working days
  • Outside the EU: individually

The Seller is not responsible for delays caused by the carrier, customs authorities, regulatory restrictions or force majeure.

5. Shipping costs

The shipping cost is either a flat rate by region or determined individually. The Buyer is always informed of the shipping cost before completing the order.

Zone 1: Austria, Slovakia, Slovenia, Czech Republic, Hungary, Germany, France, Italy, Belgium, Netherlands, Poland, Portugal, Spain, Sweden, Denmark, Finland, Luxembourg, Monaco, Serbia.
Zone 2: Albania, Bulgaria, Estonia, Ireland, Malta, Montenegro, Norway, Romania, Switzerland.
Other countries: shipping cost determined individually.

Shipping prices are indicative. For orders delivered outside Croatia, the final shipping cost will be confirmed individually after the order, depending on the destination, size and weight of the shipment.

6. Customs, VAT and import charges

  • Within the EU: no customs duties.
  • Outside the EU: all customs duties, import charges and local taxes are borne by the Buyer.

Unless DDP has been agreed in the contract, the Seller is not responsible for these costs.

7. Shipping of batteries (dangerous goods)

Products containing batteries are subject to dangerous goods (DG) regulations. This may mean separate shipment, longer delivery times and special handling. In some cases sea freight may be required (6–12 weeks).

8. Shipment insurance

Shipments are insured as standard by the carrier in accordance with its terms and conditions. If the Buyer requires higher insurance cover, this must be requested before the goods are dispatched. The Seller is not liable for damage exceeding the carrier's limit of liability unless additional insurance has been agreed.

9. Shipment tracking

The Buyer receives a tracking number where available. A shipment may be split into several parcels.

10. Receiving the shipment

  • A signature is required on delivery.
  • The Buyer must inspect the shipment on receipt.

Visible damage should be noted on the delivery note and reported without delay. If obvious defects are not reported without delay, the shipment is deemed to have been received without visible damage.

11. Transfer of risk

Risk passes to the Buyer:

  • DAP / DPU / DDP – on delivery
  • EXW – on collection from the Seller

12. Change of delivery address

A change of address is only possible before dispatch – please contact info@actionyachts.eu.

13. Lost or damaged shipments

After the goods have been handed over to the carrier, the Seller will provide full assistance; the claim is handled according to the carrier's terms.

14. Delivery delays

The Seller is not liable for indirect damage, loss of profit or business losses resulting from delayed delivery.

15. Force majeure

The Seller is not liable for failure to perform its obligations in the event of natural disasters, war, pandemics, strikes, transport restrictions or measures taken by public authorities.

16. Limitation of liability

The Seller's maximum liability for damage arising in connection with transport is limited to the value of the goods delivered or the carrier's limit of liability, whichever is lower.

17. Personal pickup (EXW)

ACTION YACHTS, D-Marin Dalmacija, Dr. Franje Tuđmana 24, 23206 Sukošan, Croatia. Pickup is free of charge; we will let you know by e-mail when your order is ready. The Buyer bears all risks from collection.

19. Final provisions

This policy forms an integral part of our Terms of Service. The Seller reserves the right to amend it. For consumers, nothing in this policy limits or excludes their mandatory statutory rights under Croatian and EU consumer protection law.
